AMAPP END-USER LICENSE AGREEMENT (EULA)

PLEASE READ THIS END-USER LICENSE AGREEMENT (‘AGREEMENT’) CAREFULLY BEFORE USING THE AMAPP SOFTWARE. BY ACCESSING OR USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS BELOW. IF YOU DO NOT AGREE, DO NOT USE THE SOFTWARE.
This Agreement is a binding legal contract between you (‘End-User’ or ‘You’) and Mount West Music AB (‘Licensor’). It governs your use of the AMAPP software (the ‘Software’).
BY CLICKING ‘ACCEPT’ OR USING THE AMAPP SOFTWARE, YOU ACKNOWLEDGE THAT YOU HAVE READ AND AGREE TO THE TERMS OF THIS AGREEMENT.
- LICENSE GRANT
Subject to your compliance with this Agreement and payment of applicable fees, Licensor grants you a non-exclusive, non-transferable, revocable license to use the Software for personal, professional, or enterprise purposes, in accordance with the terms specified in this Agreement.- 1.1 Personal or Small Business Use
- This license permits:
- Individual composers or small businesses (fewer than 10 employees) to use the Software for their game audio projects.
- This license covers standard features and does not include advanced customization or integration support.
- 1.2 Enterprise Use
- Organizations with 10 or more employees, or companies using the Software for large-scale productions, require a separate Enterprise License Agreement (ELA).
- The Enterprise License includes:
- Additional rights for internal collaboration and multi-user installations.
- Support for customized features or integrations.
- Access to premium support services.
- To obtain an Enterprise License, contact Mount West Music at contact@mountwestmusic.com.
- USAGE RIGHTS AND RESTRICTIONS
You may:
• Install and use the Software on a single device that you own or control.
• Access updates and features provided by Licensor during the term of your license.
You may NOT:
• Copy, modify, or distribute the Software or any part of it, except where explicitly permitted by open-source licenses as described in Section 5.
• Decompile, reverse engineer, or disassemble the Software, except as permitted by applicable law or open-source licenses.
• Use the Software for illegal purposes or in violation of applicable laws.
• Share your login credentials or allow unauthorized access to the Software.
• Use the Software in a manner that violates third-party intellectual property rights. - OWNERSHIP AND INTELLECTUAL PROPERTY
The Software, including proprietary code, trademarks, designs, and accompanying documentation, is the exclusive property of Licensor. Portions of the Software may include open-source components, which are governed by their respective licenses as described in Section 5. All rights not expressly granted in this Agreement are reserved by Licensor or the applicable open-source licensors. - SUPPORT AND UPDATES
• Licensor may provide updates, bug fixes, or new features at its sole discretion.
• Updates may be required for continued use of the Software and will be provided with reasonable notice through email or in-app notifications.
• You are responsible for ensuring that your contact information is up to date to receive such notifications. - OPEN-SOURCE COMPONENTS
The Software contains components licensed under open-source licenses such as the MIT license or similar. These components are identified within the Software or accompanying documentation.
You agree to comply with the terms of these open-source licenses, which may grant you additional rights beyond those provided under this Agreement.
For more information about the open-source components used in the Software and their licenses, please refer to the files’ content description.
To the extent required by these open-source licenses, you may have the right to access the source code of these components and to modify and redistribute them under the terms of their respective licenses. - DISCLAIMER OF WARRANTIES
The Software is provided ‘AS IS,’ without any warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. Licensor does not guarantee uninterrupted, error-free operation of the Software or that it will meet your requirements. Open-source components are also provided ‘AS IS’ under their respective licenses. - LIMITATION OF LIABILITY
To the fullest extent permitted by law, Licensor will not be liable for any damages arising out of or related to the use or inability to use the Software, including but not limited to direct, indirect, incidental, special, or consequential damages, even if Licensor has been advised of the possibility of such damages. - TERM AND TERMINATION
This Agreement is effective upon your acceptance and will remain in effect unless terminated. Licensor may terminate this Agreement immediately if you breach any terms. Upon termination, you must delete all copies of the Software. - PRIVACY POLICY
The Software may collect usage data to improve functionality and user experience. Please refer to the privacy policy in https://mountwestmusic.com/amapp/privacy-policy/ for detailed information on data collection, use, and protection. - AMENDMENTS
Licensor reserves the right to modify this Agreement at any time. Updated terms will be presented to you upon accessing the Software after a revision. Continued use constitutes acceptance of the modified terms. - GOVERNING LAW
This Agreement is governed by the laws of Sweden. Any disputes arising from this Agreement will be resolved in the courts of Sweden. - CONTACT INFORMATION
